Pre existing small rock crack in my windshield,now after an accident ICBC will not replace it?

i had one old small, say nickle sized crack from a rock on my windsheild, and got into an accident which resulted in two LARGE highline fractures in the windshield and ICBC is claiming that the winsheild was already wrecked to begin with because of the small rock crack that btw in no way affected the 2 large scratches i sustained during my accident, that they will not replace the windshield. does this sound fishy? is there anything i can do? should i try and fight it?Pre existing small rock crack in my windshield,now after an accident ICBC will not replace it?
They are saying if you had had the small defect repaired, the windshield would have been up to spec, but without it having been repaired, it was worth less. I suggest shopping for a used windshield at a wrecker's yard.

I did that some years back, I had a $500 deductible at the time, found a rear window for my wagon for $75, it cost me $75 to have put in. Retail on the window was almost $800 at the time.Pre existing small rock crack in my windshield,now after an accident ICBC will not replace it?
The insurance company is denying the claim for the windshield because it had prior damage. They are within their rights to do so. The small crack may have weakened the windshield, causing the 2 large cracks in the glass.
ICBC doesn't usually deny claims or portions thereof without a good reason and evidence. You might want to try and ask ICBC if they would be willing to pay a portion of the windshield replacement if they're not willing to pay for the entire replacement. If not then you will have to try small claims court if you feel this is worth you time.
